The mayor of Consumer Affairs reports on the moratorium on the payment of consumer loan installments (20/04/2020)

The mayor of Consumption, Encarna Navarro, has informed, through the Municipal Office of Consumer Information (OMIC), of the rules so that consumers can avail themselves of the moratorium in the payment of quotas of consumer loans, as already previously reported on mortgage loans.

This measure is intended for those debtors, guarantors and guarantors who are in a situation of economic vulnerability. As a consequence of the COVID-19 health crisis, a natural person, whether the main debtor, guarantor or guarantor of the main debtor, who is in a situation of economic vulnerability, may request the temporary suspension of the contractual obligations derived from all their loans.

or credits, which are in force on the effective date of this measure (April 2, 2020). It can be requested from April 2, 2020, up to one month after the end of the alarm status. The request, accompanied by the required documentation, can be submitted to the creditor through any means that records its receipt.

If the applicant for the moratorium cannot provide any of the required documents, it may be replaced by a responsible declaration. The moratorium implies that during the suspension the full fee will not be paid (neither amortization, nor ordinary interest, nor default interest). The suspension will be for three months, but could be extended by agreement of the Council of Ministers. To request the moratorium, the potential beneficiary must be in a situation of economic vulnerability as a consequence of the health crisis caused by COVID-19.

To do this, the following conditions must be met together: 1) That the potential beneficiary becomes unemployed or, in the event of being an entrepreneur or professional, suffers a substantial loss of income or a substantial drop in their turnover of at least 40%. 2) That the total income of the members of the family unit does not exceed, in the month prior to the request for the moratorium, which in general will be the limit of 3 times the monthly Public Indicator of Multiple Effects Income (IPREM ).

There are other exceptional cases. 3) That the total of the installments of the mortgage loans that can benefit from the mortgage moratorium, added to the amount of the expenses and basic supplies, is greater than or equal to 35 percent of the net income received by all the members of the family unit. 4) That, as a consequence of the health emergency, the family unit has suffered a significant alteration in its economic circumstances.
