The Eagles Municipal People take to Parliament a proposal to support the reform of local government (20/03/2013)

The Municipal People's spokesperson, Diego Martínez Parra, rise to regular full-March, for study, debate and approval, a proposal for a new regulation on the local government proposed by the Government of Spain.

The proposal, to be discussed in plenary by all political groups represented municipal, reads as follows:

Since the entry into force of the Law 7/1985 of April 2, Regulating the Local System, has been nearly 30 years, while there have been two dozen amendments to its original text.

It should be noted that it is time to adapt the framework of complex legal status of Spanish local government.

The reform of Article 135 of the Constitution, as amended in 2011, includes the principle of budgetary stability, as that which must govern any government.

Result of this provision, developed and approved the Organic Law 2/2012, of 27 April, budgetary stability and financial sustainability.

This reform has as main objectives, collect basic legislation regulating local government: to implement the principle "an administration, a competition" avoiding duplication and overlapping of competences developed by other administrations; rationalize the organizational structure under the principles of efficiency, alignment commitment to this policy on financial stability and sustainability.

Based on the fulfillment of the objectives set out in the previous paragraph, will be achieved avoid jurisdictional system that blur the responsibility between different administrations and citizens resulting in situations of uncertainty, not knowing for sure what Administration is responsible for public services that are offer.

Moreover, in a time when compliance with European commitments on fiscal consolidation process is a top priority, the local authority, as it can not be otherwise, should contribute like the rest of this Administrations objective rationalizing its structure, sometimes oversized, and ensure financial sustainability and adapting to the guiding principles of the Organic Law 2/2012, of April 27, Budgetary Stability and Sustainability, issued in implementation of Article 135 of the Constitution, as mentioned above.

This reform is based on competency titles listed in Article 149.1.14 ª of the "General Treasury and government debt", in Article 149.1.18 ª of the "Legal Bases of Public Administration" and Article 149.1. 13th of the "rules and coordination of general planning of economic activity", with special emphasis on safeguarding the financial adequacy of local treasuries guaranteed by Article 142 of the Spanish Constitution, in relation to the exercise of autonomy Local constitutionally recognized in Articles 137, 140 and 141 of the Constitution.

Through constitutional backing foregoing, with this reform, local government shows its commitment and support of a definitive way to this basic rule, which links in a close coordination of local administration with other administrations.

Regarding the text set out in the preamble, the Municipal People in the City of Eagle propose a vote the following proposal for approval:

Supporting reform, ensuring the sustainability of public services required by citizens; basic principle of local autonomy and commitment to the European Charter of Local Self-Government.

To support this reform, as it is an adaptation of Law 7/1985 of April 2, Regulating the Local System and confirming the commitment adopted in 2011 in relation to the reform of Article 135 of the Spanish Constitution, which led to the development of the Organic Law 2/2012, of 27 April, budgetary stability and financial sustainability.

To support this reform, since it consecrates the principle of "an administration, a competition," avoiding duplication and overlapping of competences developed by other administrations, streamlining the organizational structure under the principles of efficiency, financial stability and sustainability and ensures proper financial control budget and on local, reaffirming the commitment of the local authority with the other administrations.

Grant support for this reform, because thanks to the development of its rules and the adjustment of local government to their content are guaranteed services more transparent, with a measurement and evaluation of them, at the same time it provides a way more efficient territorial administration with better coverage and greater resources.

FEMP request the analysis and support for the proposed modernization and adaptation of Spanish municipal plant.

To reaffirm its support for the Government of Spain, in this case, in the development of local reform posed, in addition to other measures already taken as the provider payment Plan developed by Royal Decree-Law 4/2012, expansion of 60 120 monthly repayment period balances that were in charge of local authorities in the settlements of participation in State taxes for the years 2008 and 2009, or the Royal Decree-Law 20/2011 of 30 December urgent budgetary measures, financial and tax for deficit reduction.

Furthermore, other such as those recently adopted by Royal Decree-Law 4/2013, of 22 February, which again includes an additional allocation of 2,600 million euros to pay suppliers.

All of them, no doubt, very positive for Municipalism.

To issue this agreement the Government of Spain, the Government of the Autonomous Community of the Region of Murcia, Political Group of the Congress, Senate, Assembly and Board of Regional Government of the FEMP.
