Ciudadanos Ãguilas asks that an artificial controversy not be fed on account of the municipal limit with Pulpí (13/01/2019)

Ciudadanos requested in July information on this possible claim filed by the City of Pulpí before the Ministry of Public Works or the National Geographic Institute for the official demarcation with Águilas, which is centered mainly in the area of ​​Cala Cerrada, also known as Cala de los Cocedores, which also marks the provincial limit between Murcia and Almeria and the autonomous region between Andalusia and the Region of Murcia.

In November, the Government sent a response, in which it denied that Pulpí had even started the process.

The demarcation of municipal terms are regulated by a royal decree that in turn approves the Regulation of Territorial Demarcation of Local Entities.

In this regulation, Article 17 specifies how the demarcation of municipal terms must be carried out and 18 regulates the procedure to elucidate a possible divergence between municipalities on the demarcation of municipal terms, as is the case of the one that affects Pulpí and Águilas.

"The regulations require that each municipality must form a committee by taking minutes with the data they have available to justify the demarcation, and these minutes should be sent to the National Geographic Institute (IGN), whose engineers must decide the final demarcation.

In addition, as in this case the affected limit is also a boundary between provinces, the provincial councils or the Autonomous Community in our case also have the right to appear, "Martinez explained.

Article 19 of the same Royal Decree indicates that when the Town Councils concerned are in compliance with the current limits, there will be no new fixation, except in exceptional cases, in which documentary evidence of material errors or procedural errors in the previous delimitation is justified.

"What the law says is that when there are already demarcation certificates, no modification could be requested except exceptional justification of a previous material error.

This point is relevant, because it would correspond to the City of Pulpí justify in this case the exceptionality of the procedure in case there is a previously approved act, "said Martinez, who adds that the official demarcation of the municipal terms of Aguilas and Pulpí can be found in the National Geographic Institute "and reflects that Cala Cerrada is divided between the two municipal areas, so only if Pulpí had justified a material error of the current demarcation act would be justified to review the current municipal and provincial terms."

In the opinion of the national deputy, the possible origin of the conflict and confusion would be in the consultation of less defined cartography, such as the one corresponding to the period between 1915 and 1960, "while the later defines very accurately the current demarcation of Cala Cerrada between both municipalities. "
